Do I need a lawyer? I was in an auto accident, the other driver was at fault and cited.?

I broke ribs and got banged up which kinda seems minor injuries to me. I was in pain for awhile and my activities were limited due to the rib pain and sleeping was hard. I was thankful I didn’t end up in the hospital in traction or in surgery or grossely disfigured or anything like that. I walked away alive! I have been prompted by most my friends to hire a lawyer and sue and told that if I don’t I won’t be compensated rightly for my pain and suffering and that that’s just the way it goes. What amount of compensation is the norm for this type of injury? and can it be awarded without an attorney?

Should I consult a lawyer for an auto accident??

Another car hit the side of my car and took off everything including the rear wheel. I suffered injuries which I didnt know about at the time i guess due to adrenaline. I have bruises and a severe headache. The car is completely totalled.

I questioned the driver if he was alright and he said yes. His car only suffered minor hurt to the left front. I didnt call the police since we both had insurance. Maybe I should have since he started blaming me when hes the one who hit me.

I took tons of photos and it’s clear that he hit my car. I am pretty certain he will tell his insurance that it was my fault and they will most likely deny my claim.

So should I get a lawyer involved instead of taking my chances on my own?

Lawyer sent demand letter to my auto insurance? What’s next?

I was in an accident 7 months ago where the police report determined I was at fault, though the associated traffic ticket was dismissed in civil traffic court due to the other car’s people not showing up to testify in favor of the cop’s conclusion. My insurance company place me at 50% as it was a lane-change dispute.

The other car’s attorney has sent a demand letter to my insurance company requesting to settle for my maximum bodily injury coverage though they feel their claim is worth WAY more than that and documentation was submitted to support their view. My insurance company answered with an offer that was half of the amount requested.

Should I have reason to be concerned that my insurance company’s offer will not be accepted and I will have to go to court over this? My company will give me an attorney, but is it necessary to provide myself with my own attorney to defend me for the amount of the claim that exceeds my insurance coverage?

They are only asking for policy limits. You do not need to worry unless they are asking for more than policy limits. And even then, most attorneys will not pursue litigation against an average person. Even if they sued you and won, you would have to be financially solvent for it to be worth the attorney’s time.

I have been in a auto accident 2 yrs ago limited threshold

First-ideally, your case should not be settled until you have completely recovered or have reached Maximum Medical Recovery (MMR). Sometimes that’s not possible. In those situations, you need a doctor’s opinion on future medical expenses and medical needs.

The cop gave me two tickets, one for Careless Driving and the other for a Provisional Violation (too many people). I have a court date in Sayreville on January 6th. The careless driving violation is a moving violation worth 2-points I believe here in Jersey. If this is your first offense you do not need to get a lawyer! You only need a lawyer if it was a DWI or you got a 5-point violation for speeding 40 miles over the speed limit. So careless driving here in jersey is a slap on the wrist and you can easily get off with no points here in Jersey. I really had a similar violation down in Sayreville 3 years back. You basically go to court, talk to the prosecutor and he will offer you a deal. You will pay approximately $450 fine to the court, with $250 going to Trenton to get you off the hook. But you will go home with no points. If you get a lawyers you fees will be like $900 total so just do what I said, I did it twice. But remember you are only allowed to do this 3 times every five years. So make sure that this is your first or second time. As for the violation of the provisional, I do not believe that this is a moving violation. I might be incorrect, but I highly doubt it. It is more like a parking ticket or talking on your cell phone. You should just be able to pay the fine and leave with no points. So overall you shouldn’t worry and save getting a lawyer for more vital things.

What forms do I need to get for custody in NJ?

My ex husband and I shared custody of our children, I had full custody but allowed him to see them everyday. He passed away in an accident recently so I am going to see a Lawyer to get a consultation on what forms I need to designate custody to someone in case I pass away.

I want to grant my fiance custody of my children in the case I pass away, he has been with me (and them) for three years and they have a fantastic relationship. I hope that I get married and have more children before my time comes. But with the tragic passing of their father I realize you can’t take time for granted.

So… what forms would I need to do this? A will, trust, poa, all of the above?? I want it to be crystal clear that no matter what he will get custody. I am worried my ex-husbands family will try to fight him which is I need the most effective documents.

Also will he have to adopt my children if I passed away since they are not technically his children??

He will need to adopt your children since there is no father he can adopt your children but they are still yours it just says that he if is like the legal father and you are the legal mother because if my dad and my mom would pass away my brother and I would go to someone in the family not our step-dad. Just talk to your lawer and he will clarify it all to you. Make sure your kids are ok with him being their legal father and if anything happens to you that he is their legal guardian. You also need to get married to him before any of this takes place. If I were you you should wait a few months before you talk to your kids about him becoming their legal guardian like you because so soon after their father’s death would be too hard on them.

If a child was sexually assaulted at age 16, how much time does she/he have to press criminal and personal injury charges? Your example was battery. Battery is an act that causes personal injury, therefore, the claim would be for battery.

Furthermore, you need to find out if battery is still on the books in illinois. If it is, you proceed with your lawsuit by determining what the hurts are. You cannot have any thing if you ahve no hurts. They may be emotional hurts, physical or financial hurts. Then add that up. If it is over the amount allowed for you to use small claims, then you will need a lawyer to sue. If it is under te small claims amount you can represent yourself. You must bring proof that proves your case beyond a preponderance of the evidence in order to win.
