A year and a half ago I had a car accident in New Jersey.?
The other driver was a 17year old who was driving their dad’s car and turned into my car.
The driver of the other car told the police they never saw my car.
My car was totaled and the cost of the car and medical expenses was covered by my insurance company.
The lawyer I gave my case to just send me a letter saying he is dropping my case because of the ‘threshold’ on my out of state policy. It’s a Florida policy.
Did I just get the wrong attorney or is this how it works?

In NJ there are 2 tort thresholds, verbal & zero. Verbal means you can only sue for very serious injury, NO soft tissue injuries. Zero threshold means you can sue for any injury. In NJ, if you live out of state & have out of state insurance, you have zero threshold UNLESS your state is a PIP state with thresholds (you can call your agent in FL to find this out). I know for sure FL is a PIP state but I don’t know if you have tort thresholds. PA has full & limited tort thresholds. You will have to contact your own insurance to find this out.
If your attorney dropped you due to thresholds, I doubt any other lawyer will take your case because as soon as they get the information on your policy, they will drop you too. All of your medicals & damages were paid. Your insurance company should be subrogating against the at fault party’s insurance for your car damages & will collect your deductible back, which they will send to you if they haven’t already. They cannot get your medicals back. That is what your PIP coverage is for.

which says.If you go through the negotiation process and don’t take the bait, the mediator can then diagnose the situation and determine whether the defense will consider asking a supervisor or claims committee to reevaluate their negotiating position, and if appropriate, give the negotiator more settlement authority, i.e. More dollars. If the mediator senses an opportunity for further settlement authority, you’ve just won the first round of negotiations. If the mediator firmly tells you that there will be no more money on the case, then you have a clear decision to make.

I need a lawyers advice on my plan of attack to get custody of my son that lives in New Jersey?
O.k. So here is some detail and history my ex and I were never married we had a very bad relationship We have 2 records of domestic violence from him on me in the court I need to fight. I was awarded custody at this time also. Like all bad relationships it didn’t end there I dropped the restraining order for reconciliation and things continued to be bad with abuse but we were not living together at the time.through being emotionally broken down my son went to live with him to show him I wasn’t trying to use my son as a pawn. Our relationship continued and stayed bad. No courts were involved. Than he dropped off the face of the earth for almost 6 mths it turned out he had a bad accident and family was watching my son to never notify me. Again we were involved but not a lot these were the only times I got to see my son. Than when I had a dispute with my neighbor I got arrested for unpaid tickets being a single mom of 2 other preschool children I had no money therefor tickets piled up. When I was arrested my ex was right there to take care of my other 2 children. I spent 10 days in jail for my fines. When I got out my ex wouldn’t let me see any of my kids. He got involved with the state to investigate me and the home situation for the kids. Before the state could finished he called them and had them take my 2 kids because he couldnt care for them but kept our son. After jumping through hoops for a year I got my 2 kids home and he continued to keep my son from me so I took him to court for visitation this is when he legally got residential joint custody of my son. Still we were together on and off this whole time but he had a lawyer and claimed that I hadn’t seen my son in all this time so we had to do supervised visits to not traumatize my son it was a bunch of crap so I did this and than I slowly got to where I got every Saturday. When I was ready for overnights he did it on his own to keep it out of the court still we were seeing each other this whole time. I did all this because I didn’t want to make waves or make him angry because we still had a violent relationship I know I was stupid. Than I met my husband today and somehow we were working things out I was seeing my son all the time at my home for week at a time even. My ex was having a baby and I was having a baby at the same time. Things were great again courts were not involved. But my son was with me all the time while he was trying to work things out with his new bad relationship. I was very happy. Than we decided to move out of state things were going so well me and my ex talked and he said we could still have visitations everything seemed fine. Since than of course I have not gotten to see my son but 3 times in 2 years and its getting harder and harder to even get to talk to my son on the phone again this whole time I’ve been trying to play by his rules to avoid the fights. Heres where it gets really bad Last time I saw my son he confided in me that he doesn’t even live with his father anymore. Turns out dad lost his woman and his home and his employment and can’t take care of my son. Dad still has not told me this but I have proof dad has not had my son for a year and half. My son has been living at his uncles house again no court involvement I have no relationship with anyone in my exs family so as far as I know nobody knows I even want my son and have stable home and income to care for him. My son is 10yrs old and I feel if he should be with one of his parents. Thats me. I have almost no contact with my ex except when he throws me a bone every once in awhile and lets my son call me. He has a brother and two sisters at my house plus 2 step brothers who he loves hanging with. I have spoken to lawyers and they said they could get me my son easily but the trick was the fact I live out of state so they want a 10,000 retainer up front this is a huge problem I do not have it. Just to clarify my son lives in N.J. I want custody to be given to me I live in Delaware but I only live 60miles away from my son so that big state line I have to pay a fortune for is not far away from my ex. There are separated parents that both live in N.J. And are even further away. It is 2 hrs away for visits. It’s not like he lives in N.J and I want to move him to California. Can anybody help me figure out my next plan of action I’m done wasting all my sons time he needs to be with me.

I was invovled in an auto accident and it was the other parties fault what should I do?
I was travling on a major highway and some guy waited untily the last second to go on a stop sign. I T-Boned him and totaled my work truck. I was working when this happened. The driver was given a careless driving ticket and I recieved a ride to the hosptial. I sufferd severe contusions to my legs but was sent back to work then next day by my Workers Comp doctor. Which is an idiot. I have two jobs, I missed three from my one and almost two weeks of the other, b/c I cant stand for periods of time. Today that driver filed a complaint against me for Careless driving. What should I do? Do I have a law suit for pain and suffering and lost of wages? Should I bring a lawyer to court with me, even know the cop issued him a ticket?
Note: I live in New jersey. Wokers comp will not pay me for the three days of work that I missed or my other job. But asked me if I had another job and how many days I missed. Wages losed = 972. I am happy to be alive, but if the guy wants to be jerk so can I.

You can get your time missed from work, both jobs, milege to and from doctors, keep a journal of your everyday activities, the way you feel, get affidavits from friends, family, spouse, etc stating the pain you are in, the changes you have gone through because of the accident. If you are married you can get loss of consortium (not being able to “spend time” with your spouse) YOu can get your truck (if a personal truck) replaced. Get a good PI lawyer, don’t sit on your but. Take pictures of yourself (if you are still messed up), pix of truck, I don’t know NJ law, but that’s what we make our clients do. If you go to a chiropractor, don’t expect a lot of settlement from the other guys ins. Company. For some reason, ins. Cos. Think chiropractors are not doctors and don’t really want to settle for as much as you will spend. They may help you more than any other doctor, and it’s ok to go, but like I said above. Good luck!

i was driving and a car behind me was going around 70 mph in a residential area,cut in front of me,did a sharp stop,and drove off.i swerved to the side so i wont hit the person but ended up over the curb,messing up my whole undercarriage making my car completely undrivable and forcing me to sell my car.
i was the only one in the car and want hurt or anything(thank god for my seatbelt)their was 2 witnesses,one of them called 911 with their cell.the cops came a minute later,asked me for license etc. and said if i was drunk or not and checked if i was on any drugs and they told me what to write down.i was panicing the whole time.i was too nervous to write the whole story down and only wrote that i went over the curb(im 18,have a mustang and the other person had a honda and i doubt they’d even believe my story).then another officer came up to me,gave me a paper and said i was being charged with careless driving and to appear in court.the town i live in has a history of car accidents and deaths because of it and the town wants me to serve time,suspend my license,and give me 6 points on my license plus pay for the damage i did to the curb as well.i hired a lawyer to help fight it for me.when i got the police report it only showed what i was being charged for and what i wrote down.they didn’t even write down the witneses names or cell number they called the police with and that was the only thing that would’ve cleared me.
i never broke a law before and never caused trouble in the town but i think think this is too much of a punishment.can they even charge me if they don’t have the witnesses that called them and do you think they will drop the charges since this is my first offense?

What does your attorney have to say about all of this? The paper the police gave you that did not have the witnesses contact information, did you get that paper on your own or thru your attorney? Your attorney should be able to get the unredacted police report, which would have all the witness information – assuming it does exist on the report or on another report the police have not provided to you.
If things happened as you said they did (re accient), I would fight this completely.
