allstate says they can only total it if repair is over 25k i;m like wtf? and on top of that i guess my rental policy is $20 and the car they assigned to me cost 21.50 so i would have to pay difference then a week later they cancel my rental policy saying i’m responsible for my car rental now i’m tired of this do you think i should just get a lawyer and have them deal with allstate i live in california and it was not my fault on the car accident but unfortunately the other party has a 10k limit for repairs/ and damage any input would help thank you

So, I understand that you either have full-coverage or uninsured/underinsured motorist coverage, otherwise your company wouldn’t be any obligation at all.
If you’re willing to get 20K for totaling the car, I don’t see any reason why they would not accept it. It may be because actually they are getting the repair cheaper, or they have some mutual benefits with the mechanic. You’re certainly very right to demand money instead of repairs. After such big repairs it will depreciate a lot.
Try hard in negotiating first. And tell them you will talk with a lawyer and show them you’re serious. I hope it melts them. Otherwise, I would at least consult a lawyer to see if I have a chance…

My lawyer said my record will be erased but I now I have to file a SR-22 in. Did she not do her job or lied?
I am 18 years old now, but last year(17 minor) I was in a hit a run accident. I did not have a license or insurance. Trust me I definetly learned from my mistake. Anyways my lawyer said a year of probation and my record of the hit and run will be erased and plus Im 18 now so my juvenile record would still be anewed. But I went to the dmv in my state, california and they said I need a sr-22! My parents payed this lawyer good money and it seems like she just lied to me about my future. I expected if I pay the price and remain a good student which I was for the year of probation, everything would be cleared. I got off probation early because of good conduct and being straight A student, also I got accepted to Berkeley and NYU. But now after all this ordeal I find out that I still have to pay a hefty insurance cost and the dmv knows about my record! Can please anybody explain to me what this lawyer did and did not do? Everytime I tried to ask her on the phone she replies by saying I need to file an sr22 and there is no way around it. And says she busy and call the dmv for further information. She told me and my family that everything will be cleared after a year and we wouldnt have to pay for the expensive insurance if we waited. What can I do? Another lawyer?

I think your attorney gave you incorrect information. You will be able to have your juvenile record sealed (you have to petition to do that). That also seals the DMV record EXCEPT that it remains available to insurers. You still have to file the SR22, and the points for the H&R conviction will still be there. This is covered in Welfare and Institutions Code section 781, and see subdivision (c)(1) regarding DMV records.
The problem is that unless you had a defense to the charge, the incorrect information given to you by the attorney would not affect the outcome–you would still be convicted of the H&R and the DMV results would be the same.

The issue is like this i had an accident that happened when i washed my car i was going out when the car was coming from behind me I heard a brake in the distance but did not think it was because it was coming at me the people form the car wash they listened to what happed and saw what happed someone saw a police offencer that was washing his car the owner of the car wash with other witnesses saw everything but the problem I have is that I had no driver’s license in the state of California i had a out side one in this case I have witnesses that saw what happen but the one who hit me saind that I got in hes way when it was obvious that he was going way to fast at a high speed and people saw what happened but the police told me that i was going to get a notification by mail a letter for what happened but I did not get any ticket what can happen or if I have to gain by having witnesses is recommended that i get a lawyer or use it as I have witnessed is that a lawyer is very expensive worse what is recommended by your opinion please help me i don’t know what to do and im seeing if my Insurance can help me my neck is hearting me but well i don’t want a case of that just don’t want problems of any kind the one whom crash me say’s that it was my fault the people who saw that wel don’t think that they saw everything place tell me what should i do or should i get a lawyer ? thank you.

Your question is too vague. Since you say you have insurance, I assume you are licensed to drive somewhere. Do you have a drivers license somewhere other than California? Do you have a California license but just did not have it with you?
Probably what the officer was saying you would get in the mail is an accident report.
If you are asking about civil liability, and you have insurance, at this point let the insurance companies fight it out. Remember, if you are licensed in California, you must file a form SR-1 with the DMV. You can state in the form that you believe the accident was the fault of the other driver. Your insurance agent can help you with this.
At this point it would probably be a waste of money to hire an attorney–future events may change that.

Can they legally do this?
My car insurance company is expecting me to pay them almost $1000 b/c apparently I was not listed as an “excluded” driver.
Last month, I was in a car accident (that wasn’t my fault) and they assured me that I was not going to be charged for anything. Later I receive a bill for almost $1000! I called and they said they’re charging me this b/c my parents didn’t put me down as an “excluded” driver (I also wasn’t put down as “included” driver either). The $1000 is what they’re charging me b/c they put me in the policy.Thing is- none of us authorized to put me in the policy. Neither did we get a notification saying that THEY put me in the policy and that I owed them that much. Now they’re MAKING us pay that fee. AND saying that they did send us something. My parents are in a contract with this insurance and according to them- the contract states that I should’ve been put down as an “excluded” driver (I wasn’t even driving at the time!). None of us knew that, otherwise we would have done that and saved this mess.
I was driving with my mom at the time of the accident and I live in California btw. I dont yet have my license (only my permit) so I always drove w/ someone who did.
So can they legally add me, charge me, and force me to pay? Should I get a lawyer? Any help is greatly appreciated. Thanks.

Get a lawyer. Way too complicated for a bunch of know it all strangers to answer this one. But, it sounds hokey. Do not just let the insurance company slide on this one. If you were not driving during the accident, this should not even be an issue, you as a passenger fall into comprehensive and liability coverage. If the lawyer finds that the insurance company is attempting to gouge your parents, they should then file charges against the company for attempted fraud, or possibly extortion.
