Car buyer got into wreck but car is still in my name-what do i do?
i sold my car about 2-3 months ago, took the car of my insurance, i do have a bill of sale, and i filled out the title registration and gave it to them
the buyer never put the car under there name, so its still in my name,
the buyer who has car insurance got into a wreck and got injured, someone hit them from behind,
know they need me to sign a power of attorney since the car is under my name
i live in texas, i called DMV and the guy said it should be ok and i wont be liable
whats going on what do i do?
Tampa Personal Injury Lawyer answers:
They DO NOT need a Power of Attorney. They WHAT you to sign something to get YOU on the hook for THEIR liability. Whoever you talked to at the DMV is clueless.
The ONLY possible reason for a POA is to allow the title to be taken out of your name. The Bill of Sale already covers that.

Tampa Personal Injury Lawyer answers:
You can sue anybody for anything, now whether you win is another story.

Lisa asks…
I was hit from behind in a multi-car pileup. We all have the same insurance company..?
I had posted this question earlier and it was deleted. I’m not sure why so I will try it again without using my Ins co name. So on Sunday I was hit from behind on I35 in Round Rock Texas. I was in the first vehicle with my husband and four kids. We were struck from behind and there were 4 cars involved. The one in the back had come over a hill and we were all stopped and he went to switch lanes and rear ended a car who in turn hit someone and you get the picture. Well I got out and called the police because the girl behind me was in a hurry to leave. So I called the police who came and took our info. He said he wouldn’t fill out a police report because the cars were move able and no one was seriously injured. We got everyones info from him. We then found out that the girl directly behind us had no insurance and her license was suspended. The other drivers had the same ins co as us.
I contaced our insurance company right after the wreck and gave the details and everyones info. We rec’d a call yesterday and they told my husband that we should go ahead and get our car repaired and pay our deductible and that we have no coverage on a rental. I got on the phone and informed him that I didn’t cause the accident and the guy in the very back should be responsible. He said he would have to speak with everyone and as long as we all have the same story our ded would be waived or reimbursed. I told him I took pictures of the accident and that if my car was not taken care of by the guy at fault I would look into contacting an attorney. I don’t want to have to go that way but when I told him this he changed his tune. We are all a little sore as well. I will be going to the dr just to be safe on Wednesday. I don’t want to have to sue my own ins co but what should I do? Will he even be held liable since the girl behind my had no ins or license? Should I sent him my pictures now to help him determine the case or save them as ammunition in case I have to get an attorney? Will my insurance company dump me if I do pursue this??
Ok so I am updating. I’m not trying to sue my insurance company. Thank you for the advice I suppose. I will definitely send them the pics. I just wanted some insight on how this might be handled. And to be honest I just really need to know will he still be held liable for my car as well since the driver behind me was uninsured and had license suspended!
Tampa Personal Injury Lawyer answers:
Sorry, but your insurance company was really only trying to help you.
ALL multiple car accidents require extra investigation, and the more cars involved, the longer it’s going to take to investigate.
Your insurance company was trying to assist you in getting your car repaired in a timely manner and get you back on the road quicker while they conduct their investigation.
Also, what in the world would you sue your insurance company for? They didn’t cause the accident. They have every right to conduct an investigation and gather all the facts of the accident before they make a decision on liability. Your threatening and bullying them isn’t going to make them work faster, in fact, you may end up hindering their investigation if you launch a harassment campaign. Stop trying to bully them, it isn’t going to work, and stop threatening them with a lawyer. It’s unnecessary and ridiculous.
So fine, if you’d rather wait until liability was accepted by the other driver’s adjuster, feel free, But you’re going to be waiting until they make that decision.
The fact that you all have the same insurance matters nada, they still have to interview all the involved parties and work this out among the several adjusters, all while following the guidelines of the state laws.
What exactly kind of ‘ammunition’ are you speaking about with the pictures? Don’t you think the pictures would be helpful in the investigation? Or are you trying to force them to work faster without providing them with the tools that would truly speed up their process? You have A LOT to learn about auto accidents and claims.

Michael asks…
In the State of Texas is there anything that can be done rather than jail time on a 3rd Dwi(felony) offense?
i was arrested on sept 4th for a dwi 3 i was in a wreck where i dogdged a car coming towrds me in my lane hit a guardrail then a few seconds later a car came down the hill and hit me in the back… well no charges were given to me at the wreck but when i was on the x-ray table at the hospital. the dps officer came in and asked me to take a breath and blood testl i refused, then he said he wouldnt make me do a field sobreity test because of my condition of my wreck so i signed a paper saying that i refused he told me he wasnt going to arrest me and take me to jail that night but he would be putting a warrent out to this day no warrent yet. but the accident rpt has me down 4 a dwi3 i have hired a attorney i was heading home from work that night and i have ppl at working willing to testify i was at work and from work till the wreck happened was about 40 mins tops. i wasnt drinking i should have taken the test but i was all shook up didnt wanna do anything what do u think my chances are
Tampa Personal Injury Lawyer answers:
So if you won’t guilty you should have taken the breath test, by law there is an assumption of guilty by refusing to take the test.
And of course ( sorry) but co-workes are know to lie about when someone left work ( or if they were drinking at work)
If your place of work has a time clock that clocks you in and out that would be much better evidence.
And if the perople ( again sorry) are not telling the truth but agreed to lie for you, it only takes one too change thier story ( or even one at work who does not like you that would lie and say you won’t there) that will make it look like others are lying for you.
I would say I would not make any future travel plans for a while.
