question regarding airbag deployment in a noncollision accident?
i drive a 2000 VW Jetta. at approx. 2-2:30am I was at a redlight on a major street that is currently undergoing construction so that certain lanes are blocked off for construction and traffic is made to merge into two from four lanes. I hit a pothole that is covered by a large metal plate at approx 15-20mph. Both my airbags deployed. I did not hit another vehicle or the concrete barriers to my right. there was no damage to the front exterior of my car indicating a collision with an object. My question is do i possibly have a legal case? should i inquire with an attorney about product liability? Or is it common for airbags to go off even if i didn’t hit something head on but hit a bump or pothole instead? should i file a police report? thanks for any advice

You could very well have had enough impact force to trip the airbag sensors. Your insurance company can sort it out.
The airbag computer will also have stored the last 1 or so minutes of data (vehicle speed, which sensors activated, foot on brake,etc.) prior to and after the deployment event. If you were to litigate this would come into evidence.

Hello everyone I would like to hear everyones opinion on what I should do as many more people out there with much more life experience than myself. I am 17 years old and I will be 18 in 6 weeks. I have had my share of screw-ups and was beginning to get my life back on track when I had some bad luck. I totaled my car on my way to work. I never thought one accident could screw my life up so bad but it did. It was the last straw that broke the camel’s back. This is my third accident and I’ve received two tickets (3 if I get another one for this accident). Insurance dropped me and I am 95% sure that I will lose my license. If the cop issues a ticket for this last one then I will. My dad wants me to join the military, the airforce to be more specific. He is certain that, at this point, is is the ONLY option and the only way I will succeed in life. I beg to differ since I believe you can do anything if you set your mind to it. I want to go to college, more specifically I want to be an attorney. My dad say he wants to help me and he will in any way he can, but in his eyes that is by going into the military. If I don’t, he is done helping me and is kicking me out of the house in 6 weeks. My parents just split up a few months ago so my mom is not in the picture anymore. I also dissenrolled from school around Thanksgiving of my senior year ( I know, bad move, and I regret it 100% but I spoke to my guidance counselor and it is too late to return). I plan on getting my GED and still have high hopes of becoming a very successful attorney. I know the military is a good option and have done quite a bit of research but my main concern is leaving my girlfriend who I am absolutely in love with. We talked about it and she will always be there for me no matter what I decide and we plan on getting married before I leave if I decide to go. I don’t know what to do. I don’t want to do into the military, but I know it will be tough if I don’t on my own, working, and going to school at the same time. I know if will be tough and I will greatly struggle especially without a car or license, but I also believe you can do anything if you set your mind to it. My jobs only pays $7.50/hr. I was making $15.00/hr working construction under the table but can no longer do that because I don’t have a car and I was commuting to New Jersey. Also, I don’t know if welfare or food stamps is an option if I move out so let me know about that if you have any knowledge regarding that. In my father’s eyes, if I don’t go I am doing absolutely nothing to help myself and therefore he won’t help me. My dad wants my decision by tomorrow and I have given it much thought, but I still don’t know what to do as it is my life were talking about and I want to make the right decision. Right now I am leaning towards not joining but I really do not know. Please let me what you think I should do. I appreciate all your responses in advance.
Thanks for all your responses so far. At this point, I don’t think I can leave my girlfriend for 4 yrs just like that. I have been doing some research on the Army National Guard and the Army reserves so I would be able to stay around with my girlfriend, keeps working, and hopefully still make my dad happy. Is 6-year sentence in fatal excavator crash an adequate number of years for this type of crime by illegal?
CLEARWATER – A 20-year-old illegal immigrant from Mexico was sentenced to six years in prison Friday, about a month after he pleaded guilty to killing a pickup driver by driving his construction vehicle the wrong way down U.S. 19 in Pinellas Park.
On the night of April 21, 2007, Agustin Palma Trejo was driving a track hoe excavator the wrong way – and without its lights on – in the 11300 block of U.S. 19 in Pinellas Park, police said.
The pickup driver, Donald Cochran, 58, of Largo, was in the oncoming lane. He tried swerving his pickup around the approaching digger, but the bucket portion of Palma Trejo’s vehicle struck the truck, causing it to spin and flip 300 feet before stopping, police said.
Cochran was pulled out of the wreckage but was dead.
A 60-year-old woman at the wheel of a Buick swerved to avoid impact with the pickup and collided head-on with a traffic attenuator attached to the end of a concrete barricade in the road to divide lanes. She was hospitalized with non-life-threatening injuries.
Outside court, Assistant State Attorney Scott Rosenwasser said Palma Trejo was working at the time of the wreck for Wave Technologies Communications, which had been contracted by Verizon to remove piping.
After he serves his time in prison, Palma Trejo is expected to be deported to Mexico.
Palma Trejo pleaded guilty Aug. 10 to a charge of manslaughter. That charge, Rosenwasser said Friday outside court, was filed due to the recklessness of Palma Trejo’s driving – specifically, his driving the wrong way down a road at night with no lights on one of the busiest roads in Pinellas County, the prosecutor said.
Palma Trejo’s defense attorney, Bryant Camareno, told Pinellas-Pasco Circuit Judge Thane Covert that Palma Trejo, then 18, was doing what he had been ordered to do by Wave Technologies Communications, even though he was in the country illegally. He was asked to move the track hoe, and did so without any other employees around, according to a woman who spoke on behalf of the Palma Trejo family in court.
Speaking through an interpreter, Palma Trejo asked that the Cochran family forgive him, but also said what happened was an accident. “I know what it is to lose a father because I have lost one, because I lost my father at a young age, and I need to be forgiven,” the interpreter said.
The family was having none of it.
“At least he can go home eventually,” Ron Wilson, Cochran’s stepson, told Covert. “Don, he will never have that option.
“[Palma Trejo] shouldn’t have even been in this country in the first place,” Wilson said.
Cochran’s widow, Ruth, is suing Wave Technologies Communications.
Camareno was interested in a sentence of about three years. Palma Trejo, who was in the United States to earn money for his family in Mexico, had shown remorse and was cooperative with police after the wreck, the attorney said.
The Pinellas-Pasco State Attorney‘s Office asked for 111 months or roughly 9.1 years.
Covert noted that both the defendant and the victim had similar characters, with both working to support their respective families. “They probably would have been pretty good friends,” the judge said

Legal advice – Partner owes me $60K?
I have a construction business I have a partner although our company is set up as a sole proprietorship under my name. My partner consistantly drew more money out of the company than I did. He is up to $60,000 more than me. The company is not doing as much business because of the economy and there are no more funds in our account.
My partner was in a car accident and is expecting a settlement of $200K. How can I get my $60K from him when he settles? Do I have any legal rights? Should I have an attorney draw up a Promissory note? Any advice is appreciated.

I suspect your “partner” may not be eager to part with $60K from his settlement. Unfortunately when it comes to person to person debts most are never paid in full if at all. I would consult an attorney ASAP before the $200K is distributed. Once he has that money it will likely be spent or secured in such a way that you will never see what is due you. You may be able to place a claim on those funds before he receives them which would make it more likely you will see your lost money. Good luck.
