Personal Accident Compensation Claim – How Much?

I was injured by another driver in a head on collision that by his own admission, was his fault ( Elderly gentleman that forgot which side of the road we drive on on in the UK, just as i came round the bend on a country road at 50mph !). Apart from the usual minor cuts & bruises i suffered a fractured & dislocated ankle & a fractured sturnem. I have a Solicitors company looking into a personal injury compensation claim. Does anyone with experience of personal injury claims have any idea of what sort of figure i should expect? I don’t want to accept an offer that is too low for my injuries !

How can I claim injury compensation?

I had an accident when my car crashed into a fallen tree on the road. I have had to take 2 weeks off work. The insurance won’t pay out although I have personal injury cover because no third party was involved.
Can I get compensation from another source? Losing 2 weeks pay will leave me in debt not to mention the medical bills.

Your going to have a hard time with this one.

I assume you were the driver of your car. As such, the only coverages that would apply to you would be Medical Payments or Personal Injury Protection (PIP). It depends on what state you live in as to if you have Med Pay or PIP.

Med Pay only pays for medical bills. It does not pay lost wages or pain/suffering. It is not a required coverage.

If you live in a “no fault” state – then you are required to carry PIP. PIP works a little different in each state that has it. In general PIP covers medical bills, lost wages. However, a lot will depend on the wording in your policy.

Bodily Injury Liability pays for injuries you cause to other people. It does not apply to the driver of your vehicle.

From what your insurance company is saying – the Med Pay or PIP (if you have it) do not apply in your situation. So there is no source of recovery under your own policy. A lawyer can’t change the language in your policy.

Now you may be able to recover from the owner of the tree. But that’s not going to be easy and is certainly not a sure thing.

There are a lot of factors that come into play.

What was the condition of the tree?
Why did it fall (such as a storm)?
Was the owner on notice that it had fallen?

Also – the tree is a fixed object. It’s a hazard that is there to be seen. You did not see it. So your own negligence will come into the equation as well.

Personal Injury, can i claim compensation ?

While shopping at sainsburys, I had a cut to the palm of my hand. While trying to get some clothes off the top rack, there was a sharp pin like object sticking out of one of the pillars in one of the aisles which i accidently hit my hand across. It removed quiet a fair bit of skin and i could see a small hole in my hand. Blood started coming out and i tried to keep pressure on it but no use.
I contacted the first aiders at sainsburys reception who tried to stop the bleeding but could not for 15 minutes. The palm of my hand kept filling with blood everytime they wiped it clean.
They then called the ambulance as they failed to stop the bleeding. The ambulance guy, upon arriving said that why call him for such minor wound. But even after 45 minutes, he was still not able to stop the blood coming out. He asked me to go to hospital with him but i did not want to waste time there so stood my ground. Eventually the blood stopped and he put a bandage on it.

He told me to go hospital the next day. I had such a bad pain in my arm all day. Next day i went to hospital and had the bandage replaced. I had to keep it on for another 2 days. Thank God it was my left hand otherwise i would not be able to work.

I wanted to ask, can i claim some compensation? Is it worth contacting some of these no win no fee companies?

Firstly, to answer your question, yes you can claim. BUT,

It would be more of a hassle to you than to any insurance company, and you may only be offered a very small amount (less than £50.00 would be near the mark)

You have stated that your hand kept bleeding badly for well over 1 hour (15 mins with the first aider and 45 mins with the paramedic) The amount of blood loss would have been substantial and you would not have been able to cope. The Paramedic would insist you went to hospital, so I think (and so would any insurance company) that you cut you hand a little and are trying to put one over’

Personal Injury claim. What is reasonable to ask for in compensation?

Ok, so in November of ’06, i was in a car accident which totalled my car. the other drivers insurance company accepted 100% liability, then proceeded to SCREW me on the vehicle settlement. im still sour about this, but unfortunately HAD to have a way to get around, so i needed the money.

I sustained an injury to my lower back muscles, which causes me problems to this very day. I have shooting pain in my lower back anytime i sit upright for prolongued periods. It effects my work, and has limited the fields of work i can engage in. Its also severely changed my lifestyle, as i was a athlete before this all.

This week, after fighting just to find whats going on for over 3 months, and getting the run-around, they called me back and offered me $250 as a settlement. I was under the assumption that this number would be significantly higher. Im preparing a formal letter right now, and was curious if people had suggestions on a number to seek to begin negotiations…
My medical bills cost about 600, because i was unable to follow through on the physical therapy. it has now been a year and a half since the accident, and i would like to pursue them paying for treatment… is that possible as well?
In Oregon, there is alot of protection for injured drivers from insurance companies. Not quite as much as the new WA laws, but significant protections. Without a Lawyer, i can take the insurance company to small claims court for up to $5000. I am considering asking for $4000 and for them to pay for ongoing physical treatment (chiropractor, massage, acupuncture, whatever works…). I feel i can justify the 4k with the medication costs (anxiety problems when in similar driving situations, im taking toprol), and general change in life functions…

Does that sound reasonable? should i be looking for more? should i be looking for less? ive never been in this situation, and have no idea exactly how to address it.

You should have been receiving treatment if you were injured. See your settlement for pain and suffering is based on treatment costs. Your settlement is usually calculated after you are released from treatment. Then the figure is anywhere from 2 to 5 times the medical costs…this without an attorney. Now, if the figures are high enough and the insurance company balks you use an attorney…then the settlement figure jumps as high as 10 times your medical costs.

You don’t always need an attorney unless your injuries are severe enough. You just have to play the game right.

Workers Comp/Personal Injury Claim?

I’m in the middle of a workers compensation claim- everything would have been filed on time until we learned that the employer didn’t have workers compensation insurance. From what I know this means that I can go after the employer personally in the form of a personal injury suit. Unfortunately bc the employer doesn’t have WC insurance the amount of paperwork I am required to have filed has multiplied. My statute of limitations deadline is right around the corner and there is no way we’ll have all the necessary paperwork filed on time. Is there any other avenue to pursue this? Can I still file for personal injury after the statute of limitations is up?
