Is this a normal thing to happen if you truly are “not at fault” in an accident?

I was hit head on in my fuel truck by a logging truck that lost
control going around the corner (way too fast)
My attorney sent a letter to their insurance stating that I have a claim for severe injuries. The highway patrol report found the logging truck driver responsible for “unknown driver distraction”, and “driving faulty equipment”.
The insurance company representing the logging truck company came back and said they are denying the claim. They said the following: “We retained experts concerning accident reconstruction and metallurgical analysis, and we respectfully deny and all all liability on behalf of our client.”

Is this normal, routine stuff. Or has my case gotten signficantly harder to prove that the logging truck caused the accident. I want your professional opinions before I ask my attorney.

What you are describing is common in some industries.
Sometimes they get away with it.

I suggest that it is more difficult for them to get away with it when it is on a public highway and there is a police report and the injured party (you) has a good attorney or insurance company to fight for your rights and protections. That’s a lot of “ifs.” The logging company is gambling that maybe
* it was not a public highway
* they can fight what’s in the police report
* your representation is not as good as their lawyers
* you will agree to a settlment that is a fraction of what they owe you, instead of fighting for the full amount
* you will not take this case to the news media to drage their reputation in the mud, and help locate other victims to come forwards to sue jointly

18 wheeler accident (insurance question) Attorney or not?

On Friday my sister was hit by an 18 wheeler. She was on her lunch break going to get lunch when the truck‘s trailer jumped in her lane and hit her. He clipped the right side of car and tore off the bumper. The 18 wheeler hit her and took off. She chased him a good 6 miles, caught up with him and he claimed he didn’t know he hit her. She called 9-1-1 because he wouldn’t stop and the police came. The BMW maybe totaled due to frame damage we don’t know. The ambulance took her to the hospital where she stayed for 3 days and 2 nights. She is on six different medications. She had what the doctors call (ALOC) altered level of conscience, soft tissue damage from her head hitting the side panel and window of the car and neck back and her whole left side hurts. The driver hasn’t apologized or anything. We have the pics of his truck and his tires are worn down from where he side swiped her. My sister is really sick, she says everything in the room is spinning, she fell when she got out of bed this morning and she is just not herself. Should she get an attorney or work it out with the insurance company? She is not a sue person no one in our family has ever sued anyone, we don’t know what to do?

Sometimes sueing is the appropriate thing to do. She needs compensated for her pain and suffering, medical bills, lost wages etc… Plus this guy needs some sort of restitution, I hope the police at least charged him with a hit and run.

Auto accident, no major injuries but totaled truck and probably can’t work a few days.?

I was driving home, about 5 blocks away and an idiot ran a stop sign and t-boned me. She was cited for careless operation but my truck will be totaled. I have been driving for 17 years and have never been in an accident, have a perfect driving record to prove it. I really don’t know what to do from here. Should I call an attorney or try to deal with it myself? I want my truck replaced but according to the blue book I would not be able to buy another truck in the same shape for the kbb price.

I was not seriously injured but am in pain of course, lower back and Doc’s think my liver is bruised or injured (minor) but I don’t think I will be able to work for a few days and will have to rent a truck to go back to work since I’m self employed.

Any advice you could give me on how to start dealing with this?

What amount can I expect to receive as a settlement for the accident I was involved in? The accident occurred in Pennsylvania. About 11 months ago I was “T” Boned by a tractor trailer in my new F150 PU Truck.
I was traveling about 35 MPH when I approached an intersection where a tractor trailer did not make a complete stop (he had a stop sign, I did not) but continued to proceed through the intersection and hit me. I was taken by an ambulance to the local hospital where they ran some tests and I was released. I suffered neck and back injuries in which I followed up with a physical therapist for a month and 9 months at the chiropractor. I incurred about $9,000 in medical bills and $5,000 in truck damage.
I did hire an attorney from the beginning but have not yet talked about any settlement. My treatment ended last week. I continue to have minor back and neck pain. What amount should I expect to receive?

You need to talk to your attorney about it. There is no way anyone here can advise you on that. Depends on how much the attorney and you decide to ask for and if they settle out of court or you have to go to trial.

Truck drivers, does your company offer the insurance that bonds you in case of an accident / another car?

My husband just changed careers and is about to start driving a truck. He went to school for his CDL and then spent five weeks on the road with a ‘trainer’ and is now at headquarters finalizing his training with the company before getting his truck.

In all the paper work he is signing and insurance papers, health and life, they have offered him a what I gather is prepaid legal help in case of an accident. It gives so many thousands of dollars of bonding and bail and an attorney. It costs approx. $8 a week. By the time life and health insurance is taken out, taxes and the loan they helped with driving school the $$ are flying out the water.

We just want to know if this is something he should really have or not. I know $32 a month doesn’t sound like much but it is all mounting up. However, if advised to keep we certainly will. We are simply seeking wisdom from experienced drivers since we really don’t have any.

BTW he is driving for P.A.M. Transport.
