some one in my family was over the influance when he had his accident but it wasent his fault it was the truck but the lawyers we have are saying they cant do any thing becouse he was drunk so if some one shoots some one and the victim is drunk the other guy dosent go to jail?
first of all he was not drunk he had one or two drinks and his brakes where not working and it was a compony truck so it was the owners responsability to get it repared and he never did
it was not a crash he drowned in a lake he was getting water becouse the owner had him a house on his property as part of the job and it did not have running water so thats happend

My husband had an accident in a company vehicle…?
Today my husband called and said he was in an accident. Apparently he “bumped” into this other car. The sun was blinding him and he could see over the hill and came up on this van and tapped their bumper. The lady who was driving was in a hurry so they decided she would just get his insurance and driver’s license info. My husband didn’t want to file it through his work because he gets a certaint amount of accidents before he gets fired and they would make him take that money out of his check. He totally didn’t realize he gave her his “personal” car insurance information. She called that day and tried to file the claim. I am the one who handles all the insurance info so he had no idea. They never called the police to the scene to file a report. What can she actually do legally? She’s going to get an estimate on the damages and we’ll just pay her out of pocket but can she actually contact his work (since she knows where he works because of the truck and has his name) and take it up that way. We just don’t want to turn this into a huge thing and it hardly did anything to her van and did nothing to my husband’s truck. I want to hear from some lawyers or insurance agents to see if there was no police report will anything she says stant up or is it just her word against his. How does anyone know she didn’t get hit another time or run into something and that his information was for that actual accident? there were no witnesses except the children in her car.

To keep this person happy you will need to keep in contact with her. Your private auto insurance will not cover this. Get her estimates, agree on a common amount and pay her as quickly as possible. Make sure she signs a release from any further claims for this incident.

Car Accident Settlement?
I was in a car accident on Sept 2007 and I was injured very badly. (A large delivery truck ran a red light and t-boned me) With the economy so bad, I lost my job and can afford to make payments on hospital bills. The collection office says they want money right away. My settlement from my accident will be revealed at the end of January. My question is when the lawyers take there % out of my check, the rest of the money will go to me and I will take care of the hospital bills myself right?

A very successful attorney parked his brand new Lexus in front of his office, ready to show it off to his colleagues. As he was getting out, a truck came along too closely and completely tore off the driver’s door.
Fortunately, a cop in a police car was close enough to see the accident and pulled up behind the Lexus with his lights flashing.
Before the cop had a chance to ask any questions, the attorney started screaming hysterically about how his Lexus, which he had just purchased the day before, was completely ruined and would never be the same, no matter how any car body shop tried to make it new again.

Car Accident Settlement Offer?
I had a car accident a while back ago in September of 2007. On my way to work, a truck similar to a UPS truck ran a red light and T-boned my car. My car was totaled! It was NOT my fault, it was the other guys fault. Now today after such a long time, my lawyer said that Farmers Insurance has offered $17,000. My hospital bills has not been paid for…I know it’s my responsibility. My question is when I get the check after the lawyer deducted their money, the remaining amount is mine and I have to go and take care of my hospital bills right. I read nothing in the lawyers contract that states it is their responsibility to pay for it. So I’m assuming, I am right? I already paid for some portion, i just don’t want the lawyers to pay for it and then it will cost me. BEST ANSWER 10 Points. THANKS

Tell your attorney that you will not settle without all of the hospital and Dr. Bills are paid by the insurance company first.
You attorney should not only be getting you your hospital and Dr. Bills paid he should also be getting pain and suffering.
So if the total of the hospital is $17k. And the car was around 8k. Your pain and suffering should be no less than 10k.
So tell him you will not take anything less than 33k. Plus his fees. If he says to settle out of court then tell him you will be hiring another trail attorney and he can take a back seat to the law suit.
